a few months back I got to work on a negative entry on my credit report. It was being reported by a CA (midland credit Mngmnet). I sent off a cccr validation letter. They were able to validate. I then offered a Pay for delete also cccr. I recieved no reply other than delivery verification from post office. T oday I recieved a phone call from Brachfeld and Assoc (noticed a hard inq a few days ago and have been waiting for this call). I talked to them only to notify them that I would not deal with them over the phone. I was plenty polite but their operator said they would not mail me anything phone only or lawsuit. I said they'd be geting a letter from me then.
Now a couple of questions. After my brief conversation with these people I was told the supposed balance. Oddly the balance they're claiming is different than anything I have in writing from MCM. it's now mysteriously about $100.00 more. I'm pretty sure that is illegal but I'll need your opinions.
What should my course of action be? Is Brachfeld a CA or an attorneys office? Should I send them a DV letter or point out their discrepancy and threaten them with my own suit, or least preferably just settle with em?

It's not a large amount but these people are shady, and I hate shady people.

How long ago did you originally become delinquent on this bill? Check your state's SOL.
As far as the difference in the validation amount vs. their new amount is concerned, it's fees, interest, etc.
Shady is the politically correct understatement. Expletive crooks is more like it when it comes to collection goons.

    Within SOL

It is within SOL. I didn't think your debt could increase once it has been sold to a CA. Which it has been a few times. I also went to the new CAs website where they layout their collection methods and it states no litigation for collections under 1000.00$ which this is. So I have a violation already since they threatened legal action hey have no intention of taking...right?

Anyone else want to weigh in? do I dv them?
