New CRA Violation: PRM w/Block!!!

    ok... I was playing around in my reports seeing how the rumplestilkskin thing was going... ;)

    and I noticed something I missed previously...

    6/2002 PRM-American Express.

    I've had a promo block since late last year.

    what type of violation is this then? Permissible purpose??? and do I sue the bureau and Amex?

    Where is the promo block violation? maybe I'll just file a complaint with the state atty general's office... what do you guys think?

    Marie,

    How's your studying going?
    I would send one of your "infamous" intent-to-sue letters. I recall, back in the day, someone sent out an intent-to-sue letter to Roadloans.com for non-permissable purpose inquiry and recieved $1,000 without much fight. They knew they were caught!!

    Hey Marie,

    I don't see how Amex could be liable for the cra's error. As far as I can tell, this would be 100% on the cra. If you have a block and they give the info to Amex, it isn't Amex's fault, it's the cra's fault. I would imagine it could fall under impermissible purpose for the cra to give the info when there is a promo block. Did you check to see if there are any FTC opinion letters on this?

    not yet.. I'll look more into it Sunday...

    just seeing how you guys can help me in the interim ;) I am inclined to think just CRA error... but I am also wondering how it happened since my file still has a PROMO block boldly printed on it.. does that not count for anything???

    Well, I would think it is definitely negligent noncompliance. Maybe you could stretch into wilful noncompliane if you could find some others in the same situation?

    My file has been blocked to PRM's for about a year, and they tried to sneak a couple in on me. I wrote them a rather stern letter - so far haven't had any more.

    I kinda think they are so used to doing whatever they please with our files, that they just can't get used to the idea that we are now all paying attention.

    Marie,

    I have the same problem with equifax. I opted out in 8/2001 and they are still going.
