Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Sassy, I know how much you've always honored everybody's work, because you may not remember this, but I do -- I believe it was in a Creditnet chat room back when that feature was active here, you were right on top of somebody who had laid claim to something I wrote, LOL... Being the consummate narcissist (it's all about me, my wife says...), of course I would remember that. You're like the residence halls R.A. in that respect -- you're helping to make this a safer place for everybody, even though you're not shy to call somebody out once in awhile. I for one thank you. Just the other day another online friend wrote me to let me know somebody had basically stolen Nutcase; I wrote the guy, and he corrected the non-attribution, which I appreciated. I agree that we all have to work together in order to encourage the incentive for innovating. Hell, we don't get paid -- we deserve at least a byline for the work. (By the way, do they still call them "R.A.s" in colleges these days?) Anyway, when I read your last message and you said "going after" I thought, "I didn't say that," and then -- lo -- I looked back at my previous message and I said "going after." Lord, that was strong -- sorry. As for fave, maybe he's at work. I feel sure he'll have something to say about all of this, LOL. Yo, Butch, you better give credit like crazy: If your book doesn't begin with at least a full page of italicized "thank you's" in tiny print (not to mention HEARTILY crediting all the deserving on your web site), you are toast, buddy. Doc
Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Without any attempt to play Butch's defence - I believe he is out of the city for a week or so and might not be able to respond.
Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! I'm flying with ya, Doc, we're coming from the same place, nodding!!!!!! whoaaaaaaaaa, I was at the message board, 3rd click to the left, we've got some serious poaching violations going on, bzzzzzz bzzzzzzz bzzzzz, call the RA (nodding, yes still called the same says my son). Sassy's clicking over, gonna give fave Butch growling dude the what for!!!!!!! ;-) Thanks vghost, for understanding too (from the previous page). I didn't know Butch was out of town, no worries though, he knows when I'm talking about him, he he he. His eyes start twitching, nostrils flare, eye brows stand on end, I envision it to be like a hulk scene sans the green ;-) Sassy
Kewl ... BTW, to bring back the original topic - does anybody know any official site for the new FCRA?
Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Do you have a magic whistle or what, LKH? hmmmmm, maybe I'll get one from santa!!!!!!!! Sassy
Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! They've not yet published the revised FCRA to the Thomas Register yet, but here's a link to the full history of how these revisions developed: http://thomas.loc.gov/cgi-bin/bdquery/z?d108:hr2622: The last link on that page (titled "Text of Legislation") links to all six versions of the revisions as they developed: 1 . Fair and Accurate Credit Transactions Act of 2003 (Introduced in House)[H.R.2622.IH] 2 . Fair and Accurate Credit Transactions Act of 2003 (Reported in House)[H.R.2622.RH] 3 . Fair and Accurate Credit Transactions Act of 2003 (Referred to Senate Committee after being Received from House)[H.R.2622.RFS] 4 . Fair and Accurate Credit Transactions Act of 2003 (Engrossed as Agreed to or Passed by House)[H.R.2622.EH] 5 . National Consumer Credit Reporting System Improvement Act of 2003 (Engrossed Amendment as Agreed to by Senate)[H.R.2622.EAS] 6 . Fair and Accurate Credit Transactions Act of 2003 (Enrolled as Agreed to or Passed by Both House and Senate)[H.R.2622.ENR] For those who are way into FCRA stuff, this is interesting stuff. For others, it's a yawner, lol. Doc P.S. The "Bill Status" link provides the statute number: 12/3/2003: Presented to President. 12/4/2003: Signed by President. 12/4/2003: Became Public Law No: 108-159.
Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Thanks, Doc. I got that one though ... and it seems like we are looking at at least 2 months to get the effective dates. Poor CRAs ... the new year will not start good for them ...
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! I believe the CRA's were behind this bill 100% - it allows federal law to pre-empt more stringent state laws.
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! And the big banks. The changes help consumer pick up the pieces after the fat. It does nothing to prevent Id theft from occurring.
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Fair credit reporting act ". . . . Q: Does the legislation deal with financial privacy? A: Yes. You'll be given an opportunity to tell your creditors not to share your information with their affiliated companies for purposes of pitching their products. Q: What do consumer advocates say about the bill? A: Consumers Union favors much of the bill, but faults its privacy provisions. For example, sharing of financial data among affiliates can go on for purposes other than marketing pitches. "Congress must revisit this (privacy protection) issue," says CU's Rob Schneider. " http://www.usatoday.com/money/perfi/credit/2003-11-23-credit_x.htm . . . . ""While consumers will have a limited right under this legislation to stop unwanted marketing by the affiliates of the financial institutions they do business with, they will not have the choice to stop the sharing of their private financial information by these companies. As a result, financial institutions will continue to be able to share such sensitive information as their customersâ?? Social Security numbers, account balances, and spending habits with the hundreds, and in some cases, thousands of companies they count as affiliates." "Without tougher financial privacy laws, consumers will remain vulnerable to identity theft, aggressive marketing and fraud. Consumers deserve a say over how this intimate information is collated and combined, shared and sold, and we believe Congress must revisit this issue." Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! AND...I still can't get my credit reports to be 100% COMPLETE and 100% ACCURATE...AND I NEVER HAD A BADDIE!!!
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Does this mean no more non-pp's under California state law for $2,500 per violation? Say it aint so!!!!
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! Is a "NEW" law gonna' make the CRA'S accept PROOF from a CONSUMERS AND USE IT...that they are now (BY LAW) required to accept??? ...OR are they just gonna' IGNORE it like they do now???
Re: Re: Re: Re: Re: Re: New FCRA!!!!!!!!!!!!!!!!!!!!!!!!!!! cinderella, It AIN'T so, LOL, the preemption was already in effect -- it does additionally preempt those laws that had been passed by the states, California in particular, that were more stringent in dealing with ID Theft. The ID theft provisions are what have been added. The majority of the state Attorneys General wanted the preemption to be allowed expire, generally -- that is what they did, included ID Theft specific provisions and ignored the states where the sunset clause was concerned (it wasn't allowed to expire). It isn't ALL more stringent state laws (those already in place) it is those that were dealing with ID Theft specifically (mostly anyway -- there are additional amendments for disclosures as well). § 625. Relation to State laws [15 U.S.C. § 1681t] (a) In general. Except as provided in subsections (b) and (c), this title does not annul, alter, affect, or exempt any person subject to the provisions of this title from complying with the laws of any State with respect to the collection, distribution, or use of any information on consumers or for the prevention or mitigation of identity theft, except to the extent that those laws are inconsistent with any provision of this title, and then only to the extent of the inconsistency. George, Exactly!!!!!!! They've still not enforced the previous amendments. Sassy
