NEW -- please help!

    Preparing to file BK but have a Discover card non-jury trial May 12. Received a Motion for Summary Judgment from Discover March 23 that asked for an answer in 20 days. Attorney said he would not oppose the Motion but he didn't explain that this could preclude the non jury trial of May 12. BK attorney just said that maybe Discover already has a judgment against us. It's Friday night -- attorney can't be reached. I don't know what this means.

    If in fact there is now a judgment -- do we have a 30 day window to sell furnishings before they can get in and do a sheriff's sale?

    Or, if we file BK how does that impact the Discover judgment.

    Please -- if someone can shed some light I would be grateful.

    If you file chapter 7, the creditor will have to stop trying to collect on the judgment and the debt is often eliminated completely.
