Hi - New user here, and I'm in the process of trying to rebuild my credit. This all started earlier this week - basic situation, I've got about a year and a half of pretty good credit and one year of really atrocious activity, 2005. I'll list all that in another post. The reason for this post - I received two calls today (no messages, of course) from Arrow Financial. Apparently Arrow just picked up in Jan. 08 a First Premier charge off from Jan. 2006 (card defunct since July 05 - last contact in December 05). My calls today were the first contact I've had re: this account since First Premier last called me. Here's the rub: - CR's pulled Monday (prior to this, taking care of other things) don't show Arrow, but show a $406 charge off to First Premier in January 2006. - Arrow claims I owe them $535, but are nice enough to settle for $480!! - Arrow says no way they'll pull from CRAs, not company policy. - First Premier claims they can't buy the debt back, and aren't at liberty to do anything since they no longer 'own the account'. So after 4 people at First Premier, I finally get to someone with a brain. I tell her I don't have a problem paying what I owe ($406), but I'll do it under the condition of dealing directly with them and would like to resolve to have the charge off AND collection removed. Theresa at First Premier says that the only way they can get the debt back is buy finding there was somehow an error on the account, and agrees with me that its questionable account was in limbo from January 06-January 08. She said she'll 'research' the account, but won't be able to get back with me until next week. So... I'm looking for advice on the next step. Obviously if First Premier goes for the $406 plus removal of charge-off/collection account - I'll do that. But if not, what should I do? Other questions - - What should the SOL be on this? The debt that sent it under right (Summer 05), or would it be the most recent activity (to Arrrow, Jan 08)?? - Is what Arrow is trying to do actually legal? If things don't work, would pursuing actin with FTC or State Atty's office do anything? - Any other advice.. much appreciate. Sorry for the wordiness, but being in the process of trying to resolve everything bad I've done.. and having this monkey come from nowhere has really pissed me off. Thanks!
