I pulled my husband's cr again, i have had 4 accts deleted thanks to CN, one of the accts was OSI, well today on my credit Sherman Acq is in its place(I KNOW they are one in the same) I was not notified though, and they reaged, acct was showing opened in 2/01 now showing 10/02 with know record of DOL, or last activity. This is reaging isn't it, and if so how do I go about any legal actions I might have againist them? Please help, I am desperate hubby and I just got married and we are really needing a home! Sorry about the sob story!
I'd say you have a good case to go after. I'd get a good attorney such as David Szwak if possible and if he don't want the case or can't take it or whatever you can try the resources forum on my message board. There are some links to lawyers in there. One link is supposed to have other links to 400,000 lawyers world wide. Surely you could find one out of a gaggle like that. (LOL) If you can't then you might have to do it on a pro se basis meaning you might have to become your own lawyer.
Thank you for the info Bill! I have to do it myself I might be fighting a losing battle! People on this board are great about the laws and legal aspect of it all, but I just want scores to where we can buy a home, I know nothing else but dispute, although I am starting to learn, otherwise I would have never of known about reaging! My husband's score dropped 58 pts because of this acct, well maybe one of the deletions too, but it was a charged off acct, so I don't think it should of dropped his score. Could it have?
Good chance of it. Takes a lot of study to be able to file lawsuits. It isn't hard but learning the ropes is and you wouldn't want to lose a good one. You bet your boots it not only could have but did. And you can also bet that its going to be difficult to impossible to buy a home with that on your record unless you pay it off and if you do that then it will be glued on the credit report and pretty hard to get off. That is unless you are willing to take some rat trap distressed property fixer upper and put a lot of money into it. I know one outfit here in OKC that specializes in "distressed properties" and they will let you in with no credit check whatever. Basically you rent to own with nothing down but the first month's rent. Sounds real good till you go look at the property and lots of times they are burn outs. Or they have been vacant for a long time in a run down neighborhood and the windows all boarded up. Usually the gang bangers have broken in and ripped out all the plumbing to sell for copper and broke out all the windows. Maybe a few mattresses have been brought in to sleep on. I'm sure you don't want that kind of a mess no matter how cheap it is but if you don't get rid of that charge off something like that is about all you would be able to buy. Sorry to be so cheery but I just want you to understand how much damage an unpaid chargeoff can do you when it comes to buying a house.
