    Hoping someone can answer this question. BK discharged 2/08 in CA - Home was put into BK and we moved out. Fremont is still reporting lates, can they do that. I've already written a cease and desist letter with no reponse so far. I'm about to write there CEO. Any info. you can give me would help. I'm also still receiving bills showing new balance, and foreclosure.

    Send them a copy of your discharge document, the list of creditors highlighting them, and tell to f...off.

    If it was just discharged last month, give them a little time to report. It often takes a month or so for changes to show up on your report, as they will update with their next regular cycle.

    Just have a little patience.

    I have to disagree with Hedwig. They should have stopped reporting lates the moment they were notified of the pending BK. Send them your BK papers with a FACTA dispute, demanding removal of the delinquencies from xx date (the date you filed).

    I think billing has to stop unless you reaffirmed, but you should clarify with someone more familiar with the current BK laws.

    Thanks everyone, yes that was my thought if BK was filed in Oct. 2007 and they are still reporting lates as of today they are in violation. I will hit hard if I don't receive the correct response from them. Just sent out a letter certified yesterday!
