newbie need help by 6pm

    I was contacted through a message at work by ACA recovery with a lawyers name on it. I am not supposed to get calls at work. After comtemplating wether or not I should call them or not after looking at their website, I went ahead and called. I've dealt with cc 's before but this guy was the rudest, most intimidating ever. What happened is I took out a paycheck advance (dumb I know) loan and at the same time I was supposed to pay them back my auto insurance company took out 6 mos worth of premiums (had cancelled) because of a computer error or whatever and it took them 4 weeks to reimburse me. Anyways so here I am short $$$ and get behind on everything.

    So back to this guy. He stated that obviously I took this out in order to deceive and basically steal this money and he wanted to know what I was going to do about it now. I told hime I had to pay my mortgage and he said he didn't care and I could either tell him how I was going to pay or a judge and that he had a summons ready to go in the morning and it would go to either my work or home. He talked so fast I could barely understand him and I sat there and just basically said nothing so then he clicks off the line for a sec and then comes back on laughing at whoever in the background and tells me I have to 6:20 Wed to tell him what I am going to do about this. The amount is for $720 but of course originally for $400 . So what do I do. I cannot pay these people all at once and I cannot pay anything but a little until next month.

    Any help would be appreciated so much as this guy is the worst.

    That is why you don't let anyone debit from your checking account directly.

    How long did it take to go from $400 to $720? And how much in fees and interest have you paid on top of that?

    I would say about three months. Yes I have learned my lesson the hard way. Bad thing too is that I had to dump my hard drive so then I could not find this payday place on here as there is so many of them and they never sent me anything.

    I do not want to talk to this man again as he is so intimidating . I would be able to pay so much a week but I am not sure if I should call him back or not

    If "ACA recovery" is a different company from the original payday loan company, then they are debt collectors and covered by FDCPA.

    These fit the sort of abusive accusations that are prohibited by FDCPA. It is also a clue to what you can expect in any further calls. Whether they are actually filing in 1 day remains to be seen.

    It is hardly news to them that if their customers can run up 80% fees in 3 months, sooner or later they will be unable to keep up, let alone pay off the debt. Have you paid any fees at all to keep this rolling?

    How did he respond when you said you might be able to make payments? Of course, that is what payday loans usually turn into, only they seldom ever pay anything down.

    Yes they are debt collectors, I even looked up their website and they are very aggressive. So should I call this guy back or what, I don't know what to do. If they would set up payments I would be fine with that but I can't afford to pay all of that at once. He didn't sound too accomodating so what is the worse that can happen.
