newbie need help with TU file

    hello everyone,

    just stumbled on this forum this past weekend, and its look great. just what i was looking for. hope someone can help.
    i recently pulled my trans unuion report and have found something very strange. this is about an auto loan i had with my local credit union about 5 yrs ago. i had bought a car through a dealer that ended up being a retagged car, the car ended up being a stolen car from Canada. when i bought the car, i took a loan from the c.u. for $42,400. i payed on time up until i found that it was stolen, and had the car taken from me by the police. in short i now had a balance of $37,277 on a car that i didnt have anymore.

    collateral on the loan was the car, which was gone. i tried working with the c.u. but to no avail. i hired a lawyer, and basically the c.u. was out of luck like myself, and had to take care of it through their insurance. we have had no contact since, but they still report an open balance of $37,277, and 90 days late as of 7/02. they have also tagged me with a charge off of $2952 in connection to this. i tried disputing this with TU, and came back accurate. i dont know what exactly to do now. any suggestions would be very appreciated.

    please forgive me for the long story, but tried making as short as possible.

    The CU might be violating consumer protection laws in your state by selling a bad car THEN trying to hit you for a charge off.

    Any lawyer should be able to write a letter for a few bucks that would scare the CU into cooperating. He should also promise to file a formal complaint with the regional office of the National Credit Union Administration who oversees the CU.

    Did your lawyer attempt any recovery against the dealer? It might be too late now but if he blew the SOL you should ask who his malpractice carrier is.

    the dealer in canada ended up being a phony, and is long gone now. i know that the credit union has been paid through their insurance, as i was told through an ex employee of their's. and the last time they reported was 7/02. loan was taken out in 1/99. i just dont understand how they can keep reporting that its still open, and a blance is left.
