newbie quest, eviction,BK&judgement

    Hi,
    Wow. I have been reading for along time! Due to a long illness I had some problems in the past with keeping up on my rent. I am now on disability and very soon will be able to get subsidzied housing. The only problem is the eviciton on my record.

    Please correct me if I am wrong in how I think this all works.

    First, without realizing what I have done I have just cleared up all the addresses and have my name corrected using my middle initial on all three of my Credit reports. This is good.
    I understand that there are 3 ways to match a public record. Name and old address. I don't know what the 3rd is.??? HELP

    If I could get the judgements off that way just to make it look good for a small apartment who would not do an actual public record search thru a eviction database. that could help.

    My next step would be to file BK. I have plenty of reason to do so. I understand that if I do this I could have the judgement VACATED after the BK. Then it would not be on a public record? This is correct right?

    If anyone knows anything about this I would truly appreciate. I have a week till I see the BK attorney and the questions are killing me.

    Also, if I do get these jdgments vacated thru the BK would the record exist on any other "eviction" database since it would no longer exsist?

    I am really a nervous wreck over this! I guess I just need to clarify the difference between the "judgement " for the apartments as a public record and is there an actual "eviciton" public record?
    Or are they one in the same?

    I am even more confussed now. This is so important to me and my son.

    I know the big apartment complex's here in FL use this APS, Application Processing Service. They have a web site. Don't remember the address at the moment. There are several rental history services out there.

    I called, they were so hesitant to give any information to me as a "consumer" They basically told me that they use credit reporting and public record searches.

    I thought she was rather deceptive when she told me judgements could NEVER go away or ANY public RECORD could ever GO AWAY. They claim to follow same rules as regualr reporting agencies..yet I did not find any help for consumers on thier web site as far as recieving a copy of a consumer reporting from thier agency.
    They gave FCRA,FDCPA etc..and a buch of housing acts.

    Just info if anyone is interested.

    A public record can only be reported on your CRA for up to 10 years. Some times it's only 7 years.

    If they renew a judgement it might be able to be reported for another term...I'm not sure.

    If you file BK just list the judgement as included in BK then it doesn't matter if it shows or not because the BK will take priority.

    These are good questions for your BK attorney.

    Thanks so much for your reply. I am still reading as much as I can. I am writing down as many questions as I can come up with.....more since reading on this board.

    If I miss this opportunity for housing I am going to be really big trouble. I have to think of my son.

    APS is going to pull your credit report when you apply with a landlord who uses their service. They'll find out who you are using your SS number, date of birth, address, driver's license number, full name, etc.

    I suggest you try to find a landlord who doesn't use a verification service... there are plenty of them out there...just look around.

    You're not going to be able to fool a service like ACS unless you change your SS number, date of birth, address, etc.

    Public records are verified by matching 2 of 3 items of info, Name, address and SS#.

    As for the judgement, if you file bk, it is a discharged debt. It can still be reported for up to 7 years from the date the judgement was entered, but it must state that it was discharged via bk.

    As for other landlord cra's, it would most likely still be there.
