I am filing the next lawsuit tomorrow morning against Gulf State Credit. I sent them a validation in August - no response. In mid Sept. I sent the estoppel - no response. Beginning of Nov. I sent a demand letter - no response. They violated the FDCPA by placing an entry on my cra when they had already received my validation. I disputed it and it was removed. They then re-reported it in Sept. So I've got them on at least a couple violations. In addition, I have filed another complaint against them with my state Dep't. of Banking, my atty. Gen'l. the Georgia state atty. General will be getting a complaint as will the FTC. As usual, I will keep the board updated.
I am very interested in this. I am also dealing with Gulf State. I just sent them a validation letter last week. So I am waiting to see if I get a response. Please keep us posted. I know you have been documenting everything. Are they the only CA that is reporting that account? In my situation, Citibank charged off the account and gave it to them, they couldn't collect and sold it to Asset Acceptance Corp. But, they are still listing it and has the nerve to notate "transferred to another lender". In the validation letter that I sent, I used the one from this board as a template. Then I pointed out the different areas of the FDCPA they were violating the the section# and a direct quote to the wording. It was very strong.
