no case number on summons

    i was served a summons with no case number and am wondering how i should respond.I have a capital one card they are suing in behalf of my llc and me.

    You should call the clerk and get it. Thereafter, file a general or special appearance.

    I also received a summons without a court number. It didn't look legit to me, so I called the court and they didn't find a case number with me as the plaintiff OR the defendant. Can they still sue me?

    I don't think so. Unless it is on record it does not exsist.

    It could be a ploy to get you to pay. Or it could be a copy of what they intend to file, but they haven't yet.

    I'd send a validation letter, if you haven't already. You may want to check back with the court periodically to see if any action has been filed.

    There has been a rash of these present on the board as of late. I wanted to know if it was possible to establish whether this was the same allegeded Plaintiff. Perhaps, this could become a sticky and more importantly, a formation for doing something to rectify this misleading practice. If not to intrusive, I'd like to know who is filing these. Any response would be appreciated.

    As it pertains to this topic specifically, I would physically go to the courthouse and check it out. Someone posted that they called a local clerk and nothing was found but, thereafter, they got hit with a notice of default. This is obviously bad news and could run a little deeper than meets the eye.

    In any event, go to the courthouse. It is important enough to warrant the trip. In addition, do as Hedwig suggests and request validation from the purported Plaintiff (in writing).
