Re: Re: No License For Skip Chase Associate If the CA is not licensed in the state, does it in ANY WAY violate 807--- False or misleading representations
Re: Re: No License For Skip Chase Associate DON'T send that validation letter. Just send them a letter asking them to validate the debt, as you don't know anything about it. Keep it simple, don't bring up a bunch of legal stuff. In the meantime, send a copy of the letter you got to the NC Attorney General and tell him you couldn't find any evidence that they are licensed in NC. Don't show your hand to them yet. See what they come back with. The AG is going to have to prosecute them for the felony, you can't. But you can have that working while you're doing the validation. If you bring any of the legal issues up to the CA, they may very well make sure all the paperwork is in order by the time you file any complaint. This way, they think you don't know all the laws, and you'll have the AG working on them in the meantime. Besides, they may have a DBA (doing business as) license and actually be legal.
Re: Re: No License For Skip Chase Associate THe NC statute clearly stipulates that all CAs doing business in NC should be licensed AND show permit # on every communication with debtors. What exactly is DBA? You mean, they could be licensed under some OTHER name? They still dont show the permit # on the letter
