Hi everyone, Got a situation here that I'm trying to deal with. Cap one CC limit $300 back in 2000. Tried to make several payments between June 2000 and Sept 2000 and one went thru but the other two got returned by bank. Last payment applied was Oct 7 2000 on statement. I think that got returned also. Have statements from 2000, 2002, 2003 up to now. No payment since Oct 7 2000. Statements show no payment was made, YET, Capital One has continually since june 2000 reported to Credit Agencies that I made payments when I haven't. I've disputed with Agencies several times and recently disputed again, sent agencies copies of the statements with a copy of credit report showing exactly what the problem was and it still came back verified as accurate. I did this because I called for credit reports and saw that Cap one had started showing me as being last since Sept. 2010. Before that statements for 18 months had "Payment Due" - $0.00. Payment/Transaction - $0.00 and yet again during those months credit report showed as being current. If you look at the $300 credit limit and then look at the balance owing $6,000+ something smells fishy. So after credit dispute with credit agencies came back as verified I decided to dispute with original creditor - since I had already done it with the agencies now it was their turn. CapOne received dispute letter April 19, 2011. No dispute mark on credit reports, no notice that they thought it was frivilous, and not a single investigation report back yet. Any during the 30 day time I was giving them for investigation, they had a law firm contact me via a letter thru the mail. I disputed the debt for it is past the statute of limitations for CA (4 yrs.). I just don't understand how Cap One can get away with reporting false information. What idiots do they have working in the accounting, finance, data entry depts anyway or are they scared into doing something illegal because they need their jobs? I'm kinda at a standstill as to what direction to go with this. Oh, and on my credit report that I received in the mail the address for Capital One disputes was Salt Lake City UT, but then looking at credit report online (I don't dispute online, just use it as a ref. sometimes) it shows the address under capital one for disputes as the one in VA. Now why, are there two separate addresses for disputes by the same company within a month apart? Utah is not that far from CA and I have vac coming, maybe I should just showup and demand some explanations as to their fraud and irresponsibility. If they can't keep their accounting straight, what makes investors think that their investments with this company are in any better shape. I just want this off my credit report - if the negative information had been reported correctly - it would be off by now. Any ideas other than to send them a get lost letter or should I do an intent to sue? qvc4u2
So, you haven't made any payments since 2000, yet here we are 11 years later and this is still showing up on your credit reports since last year. Per the FCRA, I don't see how the CRAs have gotten away with leaving this on your reports. I think you're at the point where you need to start threatening the CRAs with a lawsuit. You've given them all the evidence they need to get it corrected, right? They're just being stubborn, so I would go after them again. You're probably wasting your time trying to get Cap One to do anything directly for you.
Thanks for replying Joshua. That was my next step was to contact the credit agencies. I had printed out the steps to request a dispute procedure method that they use to continue with the paper trail that I have created, but I received a letter from Capital One in the mail today and it was a computer system error on their end and they have corrected the problem, and removed any remaining balance on account and have requested that the account be deleted from credit reports. They also stated that I should allow 60 to 90 days to make this update - I will make copies of this letter and send it to the credit agencies myself also just so I know that they received it. And of course Capital One apologizes for any inconvience they may have caused. I will also fax a copy of this letter to the attorney's office that I sent my dispute and request validation letter to. I requested validation because I wanted to see what actually came back from Capital One after I had sent them all my statements from 1999 and on. Even though I knew this account was past SOL. How many other people have had this happen - computer glitches that goes on and on until we finally send everything we have to prove the point. Well at least this was the only adverse thing on my credit report and now my credit report will be even better. I've read alot on the boards, read the FCRA, FDPA, Rosthal Act (California), state laws, etc. Even with all the reading I still felt intimidated to do anything. I'm so glad I received that letter - felt like I won the lottery!
