I sent several request's to US Bank for permissible purpose for pulling my credit report. I got no response from them for over 3 months. I finally did a letter through PFB. I get a response from a lady with US Bank via email stating that they show no reason why they pulled my credit and that they don't have a application on file. I have also NEVER had an account with them. I then sent the a letter saying I plan on filing a lawsuit for the FCRA violation. Now they send me back an email saying that they are going to remove it from my report. Isn't it a little late for that? Can I still sue? I have proof when they pulled the credit report and I have an admission from a company rep. saying they didn't have permissible purpose!!
Just because its not on your report, doesn't mean it didn't happen, and doesn't mean they don't owe you $1,000
Re: Re: NO PP, can I sue?? That's what I was thinking. I just needed someone to confirm it. I have sent an intent to file suit letter to their registered agent. Just waiting to hear back. Thanks!!
Re: Re: NO PP, can I sue?? Per your letter attached...you had no reason to pull my credit report...that is a violation of the law and is subject to fines of $1,000.00 or more plus court costs. I will let you off the hook with a small fine of $500.00 payable to me in 10 calender days from receipt of this letter. The payment of this small fine will be mutually beneficial to avoid SMALL CLAIMS COURT.
But aren't we supposed to let it go when they make it right. You know like they let it go when when we make it right by paying a debt and they let it go by taking it off our reports.
Re: Re: NO PP, can I sue?? i can never tell if your agreeing with me or if its just a poor attempt at a cheap shot. is it worth suing to you if they are removing it? if you want to, go ahead and file suit.
Re: Re: NO PP, can I sue?? i've worked with usbank for numerous years, and they typically would refer you to call customer service (or the appropriate department). i have never known them to respond via email. was the email from customer service or was it from the support department that receives the emails?
Re: Re: Re: NO PP, can I sue?? SPEAKING OF E-MAILS...I get with some credit cards... "FOR SECURITY REASONS---CALL THE NUMBER ON THE BACK OF THE CARD" WHAT ARE THEY AFRAID OF???? BECAUSE I AIN'T AFRAID OF E-MAIL--I PREFER E-MAIL!!! Had I wanted to call--I WOULD HAVE!!!
Re: Re: Re: NO PP, can I sue?? they don't want to say something in email that can be held against them......
Re: Re: NO PP, can I sue?? It depends, lbrown ... If you were denied a credit because of "too many inquiries", and if a creditor admits in writing that he had no PP for an inquiry, somebody has to pay for it. I would definitely agree with you, but a CRA and morality ... somehow doesn't click, you know ...
Re: Re: Re: NO PP, can I sue?? I didn't email them. I sent a complaint via Planet Feedback and THEY emailed me. This is the email address it came from and the name of the lady that emailed me is Sue Pierce: ecu@usbank.com
