About 2 months ago I sent letters requesting validation of debt to 2 collection companies - Palisades and Cavalry. Neither one of them EVER sent me anything. I found out about them from my credit report. Since they have not responded, can I send copies of those letters and the signed certified mail receipt cards and get them removed from my credit reports? Thanks for your input............ Jet
If you have asked for validation within the 30-day period after first contact (which would be when you saw it on your credit report if they never sent you anything) AND they have not responded with the necessary information AND they are reporting on your credit report, THEN they are violating the FDCPA and you can take them to court. I doubt that sending copies of your letters to the CRA will do anything but waste your postage.
It will waste your postage and failure to validate isn't really applicable to verification anyway. The FDCPA and FCRA are two distinct Acts. However, Palisades and Calvary can be deleted if you hit the right data fields.
One addendum: Continuing to report is not continued collection activity -- sending an UPDATE -- or responding to a verification request sent through the CRA *IS*... As long as the data is there as it was BEFORE they validation request was received, they have not performed collection activity *AFTER* the validation request was received. That's why you typically want to dispute with the CRAs as soon after they've received the validation request. So that if they VERIFY the tradeline with the CRAs, they have actually performed MANUAL COLLECTION ACTIVITY...
