No validation after 30 days. HELP.

    I had a charged off account that was sold to a CA. The original charge off was 7 years ago and is no longer on my credit report. Now after 7 years this new CA wants me to pay. I live in Ohio so the SOL is out of the question for me. I have sent the letter to validate the debt but have had no response in over 40 days now. What is the next step? Please help! Thanks

    Estoppel giving them 15 days to responnd.If they don't respond to that send them an intent to sue letter.

    Is this the only option to give them even more time? Doesnt seem fair. I thought if they did not respond after 30 days that they would not be able to pursue the debt? What does the 30 day rule apply to?

    What kind of an account is this?

    Credit Card?

    or

    Fixed Contract?

    it was a credit card with Bank one for best buy

    1*It's not about fairness. it's about building your paper trail so you can nail their hide to the wall with it.
    2*They can peruse the debt as long as you permit them to; there is no 30 days.
    3*To how long A after a CA informs you of a debt before they may assume it's valid.

    STATUTE OF LIMITATIONS (IN YEARS)

    Open Acct.: 4

    Sales Contract (UCC2-725) 6
    Written Contract: 15
    Domestic Judgment: 21 renew every 5
    Foreign Judgment: 21 renew every 5


    A CC is ALWAYS an open account.

    Tell em to stick it.

    I thought the SOL for credit card debt was like 21 years for ohio????

    That is only if the debt is reduced to judgment within the SOL. A judgment in Ohio is valid for 21 yrs, with renew options every 5yrs by the judgment creditor. A CC is an open account and the SOL in Ohio is 4yrs on open accounts.

    Tell them to go f*** off; they missed the window 3 years ago.
