Background: This mortgage broker pulled our credit under the blanket of the company he "works" for. He sent e-mail to us saying that we could have never been accepted by "his company" that he would have to broker out our loan. Now, if we could have NEVER been accepted by his company, why in the heck did they pull our credit twice?? Then the broker submits us for another loan with First Franklin, which we never authorized, but he tells us after we question him about pulls on our credit report?? Can I sue for Non-pp?? they pulled your report twice??? from what I know about mortgage apps they pull your credit and see what you have and advise you from there if they can or not get you approved for a loan. MB usually share or forward this info to lenders to get you approved. a report is usually pulled a 2nd time for 2 reasons that I know of 1. before the close of the loan 2. unless you authorize it and inform them that something on your report has changed since the previous pull. if neither is the case, in my opinion they had no PP for the pull and would be liable. I would write the MB co a letter reqesting that they verify in writing the reason for the pull not just verbal then depending on what there response is, you may be able to file suit this would be evidence and possible admission on their part I hope they respond oh send it CMRRR

Mortgage Brokers "broker" mortgages. They search several companies looking for "the best" terms etc. -The inherant nature of the "relationship" between the consumer and the broker is almost entirely "credit score" related. -I would bet a dollar that not only is the access permissible in itself based on this "relationship", the poster most likey signed OR AGREED to have their credit investigated as well. -I agree the poster should have been more informed by the broker, but illegal, not hardly
