Hello, I have a MAJOR problem. We ordered a laptop computer through CompUSA online. They shipped it via FEDEX, and we used our AMEX Platinum. This was ordered July 4th. The computer never arrived, we were billed $1707.00. After several emails and phone calls with CompUSA they said it was delivered and left on my doorstep via FedEX on the 10th of July. NOBODY signed for this package! We never got it, and CompUSA refused to do anything about it, seeing as there was a signature release on my address. There was a sig release for my address, but for some documents I signed for last year! FedEX left a $1700+ package on my doorstep, for it to be stolen! I disputed the charge, and AMEX gave me temporary credit, and when CompUSA rebutted, they reversed (amex) the temporary credit. Now our bill is due (in full mind you) and we don't want to pay $1707.00 for a non-received computer. FedEX refuses to do anything about it, seeing as how there was a release on file, and CompUSA refuses to do anything about it too. I sent an intent to sue to CompUSA for violations of the Uniform Commercial Code, but they have not responded. Nobody at FedEX or CompUSA will try to resolve this. WHAT CAN I DO? Does the Fair Credit Billing Act kick in here, I tried in more than good faith to resolve this issue. Please help!!!
Did you send your dispute to AmEx via snailmail? It has to be in writing. If so, and they accepted the FedEx and CompUSA's explanation, then I would just file a claim on my homeowner's policy, and ask the insurance company to "subrogate" the claim - which means they would try to make CompUSA or FedEx pay them. The insurance company can sue them.
