What do you do in the event that the collection agency sends a copy of your statement via regular US Mail? I know that this is probaly all that they have. Should I say I didn't get it?
What is the point? If you tell the CRA that the CA did not validate, the CA will say they did. Who do you think the CRA will believe? If you sue and tell the Judge you never got it, the CA will say they sent it. I doubt the Judge would rule in your favor on this.
What is the purpose of disputing then? They did not send me validation, they sent me a printout that I could make myself with one of my computer programs.
The reason you do the validation is that many times they cannot validate the debt and they will remove it. That just happened to me. I don't know how you did your validation letter but you may not have done a good one. If you just basically said "please validate", they will do as little as possible and send you a computer printout like you got. If you do a Lizardking validation letter, asking for specifics, like a signed contract, proof of identity, etc., they are forced to do more work. Sometimes (especially on paid collections) they will not validate to avoid the work. They just remove. Other times, they do not have the info and have to remove. And, other times they will just send you a printout. The point is that sometimes it works, sometimes it doesn't. Just be sure you do it the right way. Like I said, I have no way of knowing whether or not you did a good validation letter. Look at the Lizardking one (there is another thread going on this now) and see if you did.
I'm glad you did the Lizardking letter. But, I do not know where to go from here after they failed to comply with your request. Maybe someone else has some advice.
What I did when I sent out validation letters is use the one from this board and I researched the FDCPA and quoted directly from it. I outlined all the areas of the act that they had already violated. I am waiting to get a response from the CAs. I got 2 green cards back, there should be more in the mail. I got a response from the original creditor's corporate office for a paid collection. I am going to deal with them today. What you should do when you are sending out (if you are not already) is tailor it to your needs. They usually know when they receive a form letter. You want it to be a little more unique than just verbatim off the website.
