i just got a letter from them (a settlement amount) stating they would give me a 45% deal. what should do first? dla was 9/98. i'm not sure whether I should send a c/d or a validation letter? thanks they sent letters last summer, but all of a sudden, they stopped. now they are doing it all over again. btw, the sol is 4 yrs on credit card accounts.
Is 9/98 the date the account charged off or the date of your last payment? If you send a c&d, they may sue you for the balance. If you validate, you may drag it out (maybe even until after the SOL).
Are they trying to collect the charge off amount or more? If more, I would definitely validate. Do you know if Northland is assigned to collect or did they buy the debt?
the original debt was $1629 (charged off amount) and they are asking for 45% of that. one of the last letters (~2002) said that it was assigned.
If the CA is reporting, you might want to settle for deletion of their TL with them. But then that would still leave the OC's TL to deal with. If the CA is not reporting and since they did not buy the debt, you could c&d them. They probably would return the account to the OC, but then you probably will pay the whole amount to settle with the OC. But that would at least give you leverage to negotiate deletion for payment of the OC TL.
How about just send a "leave me alone letter". If this was chargedoff 9/98, you defaulted 180 days or so prior to 9/98. The SOL ran long ago.
Yep for a fact. chargeoff of 9/98 puts dola at 3/98. sol is up. they lose. mail them whychats sol letter from cardreport.com and be sure to include a tissue.
thanks so far is there a letter like that on the forum? or if there is not, how should i word it? is it the same as a c&d?
i replied the same time picantel!! i have an sol from why chats site sort of ready to go. i'll go and finish it now and send it out tomorrow. you think charmin will be alright? or should i just send sandpaper?
