Hi again, Thanks to those who answered my earlier post. I need clarification on whether the entity that contacted me can legally do so. I live in Hawaii, and CA's are required to be registered. Out of state CA's can attempt to collect here, but they also need to be registered, and can only use mail, fax and telephone. The question: I am being contacted by a "law firm" -- P. Scott Lowery (of questionable reputation, as my reading has told me), and the creditor is listed as CACV of Colorado (also of questionable reputation -- thank you Bud Hibbs!). Who is the CA here? Lowery or CACV? To my thinking, Lowery is acting on behalf of their client, CACV, therefore, CACV is attempting to collect a debt here, and needs to be registered (which they are not.) One more thing -- for one of these lawyers at Lowery's firm to sue me here in Hawaii, he or she would have to be licensed to practice here, right? Again, thanks in advance. Joya
When in a gray area, I always contact the state licensing/bonding peole and ask directly and specifically. That should clear it up for you! Be sure you are contacting the right dept. though..use the info in my link to the state laws to help you find out who that is.
