Not sure how to proceed...

    Just got DH's report back from EQ...6 deletions!! Our charge off from Nat'l Auto Credit...deleted. Heres the kicker. Sherman ACQ. showing verified for the balance of $5922. We were sued in Sept of 01 from Colorado Capital ACQ. for this account. Suit was dismissed 6 mos. later for lack of prosecution. We quit paying in April, 02, and this is showing DOLA as 7/98 on Shermon. During the period of the suit, Gulf State was also trying to collect!! I sent them C&D stating collection on deficit was time-barred. How can I get sherman off here? Patti

    Congrats on the deles!!

    I wish I could help you...I have had 2 repos removed from 1 cr and trying to get the last one taken off the other. Those bastards say I filed bk on it when I didn't. (can you say libel per se???) Been researching that one all day. Anxiously awaiting settlement approval by the judge in the class action suit that is pending. ANYHOW, lol....

    Hmmm...I dont see how the hell they verified. They arent even the ones carrying the debt, are they? Have you asked for validation from Sherman? Sherman is reporting on a debt that you were sued on by someone else?? Just want to make sure I understand before shooting my mouth off, hee hee.

    Yep, Nik, you are exactly right!! Sherman supposedly bought the debt from Colorado Capital!!!
    I'm gonna nail somebody's a&&!!! As for having the repo deleted, I don't think NAC is even in business anymore!!

    I wonder if it would work to do this...that is, if youre up to contacting Sherman.

    In a nice letter, state to them that you understand how the process of buying debts from other companies works. Inform them that the prior company sold them a debt that was not recoverable since you have been sued for it and it was dismissed. If they have further questions, they can contact the people they bought it from, since they sold them an account they KNEW could not be collected on. May be a bunch of rubbish, but at least it turns the tables. Also, specify that, since this is an invalid account, since it was dismissed in court, that they have the option of removing it form your report, or you will sue for disparagement of credit and other fraud violations. Tell them if they desire to pursue their legal options against the company they bought your debt from for not disclosing its non-collectibility, you can refer them to a great lawyer and you will be willing to help them in their cause, i.e. documents and paperwork regarding the debt to be invalid and showing the dismissal in court. If they are not interested in your help, remind them they have no legal recourse against you, since the debt was sold to them on a fraudelent basis. You can try sending a letter to the cras as well.

    Like I said, it may be full of hot air, but then again, it may work and best of all, they may go after the other company, lol. Good luck!!
