I have posted once or twice before and everyone was most helpful and I apologize for a long post. I have a discharged chapter 7 (Dec 2001), none of my creditors showed up for the 341/314 hearing, no notification from the court that the paperwork they sent out to the creditors alerting them of the pending bankruptcy, was ever returned due to address error etc. This past spring, I received several annoying calls from a collection agency on a car repo (the original car dealer was included in the bankruptcy and the original collection agency which handled it for the car dealer) and I sent all the "new" collection agency and the original car dealer a certified letter, saying that they were in violation of the (cited some stuff) because the account was included and discharged in chapter 7 with no objection from anyone, and to not call me again. I have the green cards to prove receipt. Now, bear with me, this past spring, I started to clean up my reports, against the advice of some members on this board, I challenged everything on my three credit reports to say that they were included in chap 7 rather than have them listed as in collection etc., anyway, the car loan kept coming back as in collections, as well as a credit card. I wrote to the credit card company and told them it was discharged, they wrote me back, I have letter, that they would update information on my reports. Ok, yesterday, I applied for car loan, told them up front about a discharged chap 7 etc. This morning, the car dealer called me inquiring about the old car loan and the credit card, they are both being reported as in collections and the date they reported to the bureau (not sure which bureau) is June 3rd. I told the current car dealer that I will bring in my bankruptcy paperwork to prove that the other car loan and credit card was included. What else can I do. Your valuable advice is so needed. I have read in other posts of people filing suit, should I hope that I get denied this new loan (credit after the chapt 7 has been exemplary) to file suit? I am really questioning what more I need to do to prove to the original car dealer, the one that I included in bankruptcy, to give accurate information to the credit bureaus. I should also report, that I have at least 3 times, disputed the account with the credit bureaus and each time it came back (American Honda Finance) as verified. Thank you for taking the time to read.
