How long does the OC or CA have to notify the CRA that an item is being disputed, after they receive a dispute notification from a consumer?
So if there is not a specifc time frame how do you know when the OC or CA has violated the FCRA when they don't report that you are disputing the account they are reporting for you?
http://www.cir-nc.com/FCRAResearcher.html read this info on this link it says if a consumer notifies the furnisher of info in writing and disputes the inaccurate information being reported on the CR the furnisher can not continue to report that information unless they notify the CRA to falg the acct disputed. so if you notified the furnisher( OC or CA) that an acct is disputedon your CR they can either delete the acct, update to be correct, or flag as disputed if they continue to report the same info.
The one caveat is if they report the information again. There is no specific time-frame where they *MUST* update the account to show as being disputed. If they never update the account again, technically they haven't violated. But, you can force them to violate (and bump the violation to a (b) violation which you can sue for) if you demand that the CRA dispute the information. If the DF (data furnisher) updates the account, or verifies the account, and the notice of dispute isn't there, then it is a violation, and its one which you could sue for, instead of just an (a) violation where you would have to have an AG, or FTC sue on your behalf for (and they would require a lot more similarly situated plaintiff's before that would happen).
