Nutcase Letter Response:opinons?

    Nutcase Letter Response:eek:pinions?

    I sent Doc's Litigous Nutcase letter with some minor changes to an original creditor on a closed, paid account. It's showing multiple late pays. The response is pretty generic. Any ideas on the next approach?

    Bump...

    Any ideas, anyone? I don't really have a suit at this point. They did ignore what I was asking for but I don't believe they are obliged by law to give me the validation I was asking for.

    Are they reporting the same information on each of the three bureaus? If it is not exact (which it usually isn't) then it seems to me that they are not only knowingly reporting false information, but they are admitting to it. Sounds like you can begin building your case on this premise.

    Just an opinion...any thoughs?

    Sounds like a good idea. I'll have to check when I get home. I'm thinking that it is a little different on one of the CRs, now that you mention it.

    Since nobody wants to reply to my post (200 views) I'll jump in here (if you dont mind) just because I have the same case pending with the only difference that I didn't receive the reply from the creditor yet. My report have not changed, but as one of you stated they report different info every time I dispute it (twice within a year) and as of right now each of them reports something different. Would that apply to me? If so, Pat, let's get them!!

    Damian,

    My initial thought here is, if they are reporting differently on the 3 CRs (Thanks again Andrew for this train of thought), then I will adopt a portion of the "Son of the Nutcase" letter and send it to them next.

    They have said they are reporting correctly. If they aren't, then I will point out their specific infractions, giving them them the opportunity to delete or be sued.

    I think the trick here is not to tell them exactly whats different on which CRs, but just that there are differences. Hopefully they will pull a hard inquiry to find out, then I'll have a solid lawsuit.

    Obviously, they could just update all 3 with their current info. But I will also let them know that even if they fix it, I have proof of the previous infractions, so in order for me not to sue, they need to delete or update to never late.

    I think this is all pretty light for a lawsuit, but it's worth a shot as a threat. Heck I'll probably go ahead and follow-up with the lawsuit if necessary.

    Of course, this is all pending that the tradeline has some differences on at least one of the 3 (fingers crossed).
