NY: Any SETTLED accts off in 5yrs?

    Hi!

    I'm looking for any New Yorkers who have been successful in having SETTLED accounts removed from their credit reports at the five year mark. Did you have to dispute it off or did it fall off by itself?

    I ask because the language of the law says "paid collections" not "paid in full collections" I would argue that making a deal to pay a creditor in settlement constitutes a "paid" collection. In the end, you don't owe the creditor any more money.

    I haven't seen a yes or no to this question anywhere in the archives. Does anyone have any direct experience in this area?

    ...another thought, this might be an issue to push to the court system to decide. I wonder if anyone has ever sued the CRA's over this issue. Does anyone know of a credit attorney in the state of NY?

    If it's paid - it's paid in full.
    If it's not in full then it's not paid.

    You can't have something paid and unpaid both at the same time.
