OC 1987, Bk 1988, Still Showing?

    The SOL for Calif is 2 /4/ 4 This is reported by the OC and still showing on my CR. Shouldn't it be off by now?

    This should have been gone since 1994.
    It's all ready been reported 10 years to long.!

    How did they get by with that?

    Hey LB! Well get this - today because of my addy dispute with EXP, I received in the mail a copy of my credit report via them.

    I use PG but thought I'd browse through and see if it was any different and this same OC that I'm refering to???? shows a credit pull in January of THIS YEAR?

    Now HOW IS THAT?????

    How do you think I should handle these folks? They never bug me, but now it's bugging me that not only are they still on my CR, but they'll doing pulls!

    Being that I'm still learning how to tread water here, can you help me out also on recognizing what violations have occured here? Please :)

    The first thing I would do is fire off a letter to them. Say you just obtained your credit report and see that they have pulled your report. Ask them what their permissible purpose for pulling the report is, and state that you want the inquiry removed or you'll be forced to take further action. (Don't say what action, just further action.)

    Anther good question is why have they been reporting this for 17 years?
    And why did't the CRS delete it in 1994?

    Hi Hedwig! Thanks for your input. I did a LOT of research in the search engine last night after reading your and LB's comments. I'm pretty sure that they didn't have PP because this is not a current debt since it was discharged in a Bk. I read a HUGE thread that was mostly between Hiding90 and LizardKing where the debate was over collecting on a debt forever scenario. But when this was dc'd on the BK, it then made the debt null and void - removing PP.

    What I really want to know now is regarding this statement that I've seen inserted into PP letters:

    "Please explain your permissible purpose for obtaining my credit report.

    Also, please arrange for payment of $1,000 by x/xx/04, or I will be forced to file suit against you for willful and negligent violations of federal law, state law and my rights as a consumer. ( I know that you said to not say what action so di I use this at a later date?)

    In your written reply please provide the name, address and phone number of your "registered agent". Your reply can be faxed to: 1.xxx.xxx.xxxx."

    First, can I add the first paragraph part and should I? Second, who is the "registered agent"?

    Hi LB. And on this exact note, what can I do about the CRA? I'll go search on CRA's reporting after SOL but I want to come back here and see what options you or others might suggest.

    Just send the CRAs a letter saying obsolete please remove.

    Are you still fighting it?

    I just don't get how they can keep on reporting something that should have been gone 10 years ago.Reagong $1000
    then pulling your report on top of it for a BK account. No PP $1000.

    Hi LB! Hope you had a happy 4th!

    It's still sitting on my CR - I still shake my head every time I see it. I've sent in my challenge to the CRA and I'm waiting.

    I like the idea of the $$$ violations. :) I'm waiting to see if they commit more violations. I figure that:

    1. They get the CRA inquiry and run it again (2nd v)
    2. They get my demand and pull it again (3rd v)

    What happens if they refuse to cough up the $ per violation? Small claims?

    Well thought I'd update this. The first acct. the one that pulled a nonpp after it defaulted 16 years ago and went through bk, have offered a measly 1K. In the course of this investigation, it was found that they have 5 other violations. Furthermore, there was the issue that they might be difficult to sue as they are 2K+ miles away.

    I refused the 1K and discovered that they tout "e-commerce" as a part of their mainstay and do business nationally and internationally. This means, I can sue them in my own backyard w/o having to go Federal. Now I'm awaiting their next reply.

    The other one, the one that did 5 non-pps following a discharged BK has just been sent notice by my atty so we are awaiting the outcome on that.
