OC Capital One incorrect info atCRA

    There is nothing preventing an OC from reporting an account that is in dispute, they only have to report that it is in dispute when they do.

    If the DOLA is sometime in 2000, and if your SOL is 4 years, then the SOL would toll sometime in 2004, but you won't know exactly which month until you know the 30 day late month (then add a month for safety.)

    If you're certain that the SOL has expired.

    Then I would send a letter requesting that they validate the information which they are reporting, the key is under the Fair Credit Billing Act, and the Fair Credit Reporting Act, and demand that they comply with Johnson v. MBNA in conclusively verifying all of the information which they are reporting from the original documentation.

    Then I would dispute the account on the CRA's.

    The SOL for suit has expired, not for reporting.

    So send them a letter (Cap1) that I want them to validate the information that they are submitting to the CRA's???

    What about a letter to C1 stating that I dispute the collection account period. Note that the statute of limitations to collect is 4 yrs in California.

    2nd, note that the information they are furnishing to the CRA's is inaccurate and request documentation, and to mark the account in dispute with the CRA's.

    Then after green card gets signed, dispute with Bureaus as Billing error??? FCBA???? Any language you would care to include.... Thanks.

    if you get anywhere with CAp 1 in your dispute process plz post it,

    from what I have experienced they will not back down.

    in my case they have willfully continued to report inaccurate, unverifable information even when they have admitted in writing that they have no proof. so off to see a lawyer I go.
