I have a civil judgement from an old oil bill, showing up on EXP only. I went to the court house yesterday, and got a copy. I know I paid it, but I paid after the judgement. I called the OC, and they searched their records and haven't been able to find me anywhere. I explained about the judgement, and that I had paid. She figures that it's still shows unpaid because I paid at the same moment that they were getting the judgement for my failure to appear (I snuck in and paid it while I should've been in court, dumb I know) Anyway, I know that's not right. No matter when I paid it, it should say paid on the docket. So, what's my next step? They are very nice at the OC, and I'm waiting to hear from someone in their main office tomorrow, hopefully. she said that she could send a letter to the court, but if she does that she'd have to put todays date on it, but it was paid 2/18/1997. Unfortunately, I don't have my checks from that far back, so I don't have proof. What should happen next?? Thanks
If they used an atty to go to court for the judgment, then he would have docs on the account. If they cannot find any records, ask her to vacate the judgment.
What I'm worried about also, is, they have no record of my payment. Hopefully they'll get it all worked out. Even if I can't get it off my reports, I want it noted as paid. It's due to come off 1/2004. It's a long time, but will hurt so much more as unpaid. I don't really have the extra $$$ to pay it again. I'll wait til tomorrow, and see what they say. The woman I spoke with today didn't really have any idea of what to do about it! As long as when they mark it paid, it doesn't change the reporting clock!
I think I have it worked out. I called the court house today, and I just need to get a letter from the OC stating that the account is satisfied. Since they have no record of me, or my payment, they are writing it out today, and mailing them to me. When the courts get it, I should be able to redispute it w/ the CRA and get that last derog removed. Technically, I owe $60 in court costs, but since the OC is writing the letter saying I have 0 balance, I don't think I'll have to pay it. Makes me a little mad though, that they never sent in the info. so the judgement would show satisfied. Imagine all the credit I've been denied because of showing an unpaid judgement all these years!
Yes, I actually dictated the letter to her, because she didn't know any better. I told her it had to say that it was satisfied on 2/18/1997. LOL I don't necessarily think it matters as much, because w/ a civil judgement the date is the date filed, not paid. But, I definately would rather it show paid in 1997!! Next, I'm sending a procedural request to EXP saying there is no way they could've verified an unpaid judgement, especially without the address and SSN. Hopefully I just get it deleted! Better old and paid, than unpaid I guess!!
That last message is worded weird. I must've read it wrong, or did you edit after I read it? Maybe I'm losing my marbles? anyway, I know nothing about vacating a judgement. I didn't know what it entails, and I didn't know what the court was showing until this week, when I got the records. The other 2 CRA's had already deleted it when I disputed--it was just exp. that was verifying over and over! I hate them, BTW! LOL
Ahhh! You had to dictate to her? That would have been a breeze to get vacated. Then you would not have to fight with Experian.
