OC has no record

    Hi,

    I have one charged off that I disputed, but was verified by CRAs twice. One month ago, I sent OC a validation letter. OC responded that they have no record regarding to the account and requested sending them a copy of my credit report reflecting the discrepancy.

    Should I send a copy of my credit report to OC or should I send CRA a copy of OC letter stated that OC has no record of the accounts CRA reported on my CR and demand CRA to remove the TL from my CR?

    Although I'm still pretty much a newbie, I'm thinking you should NOT send your credit report info to the OC. I've always read you shouldn't send them anything that might help them. If they cant find the account, then I'd go the "demand CRA to remove" route. I've got the same thing going on. over the phone, Bank of America couldnt find the account, even with a partial account #, DH name, my name, and birthdates. When they asked for SS#, i said NOPE. I thought i had given them enough info (maybe even too much!) and I figure if they cant find something after all that, then it doesnt exist. I've sent a validation letter, and if they respond saying they cant find the account, and request more info, i will send that to the CRAs as proof.

    I hope this is the correct way to go about this. Sorry if i'm wrong! Someone w more knowledge please respond!

    Did you send the validation CRRR? Did you get the green cards back?

    If so, send letter with the OC's response to CRA demanding they delete. If they don't, file in small claims court against both the OC and CRA for willful noncompliance.

    Obviously if the OC has DOCUMENTED to you that they have no proof of the alleged debt...yet both the OC and CRA verified the tradeline...they blatantly violated the FCRA.
