Hi all, I had surgery in January, set up a payment plan wiht the surgical centere, was to pay the final $350 this month by the 30th. A lady from the Accts Rec. dept for the surgical center called my house Tuesday looking for me. They talked to my live-in GF. (they did not/do not know who she is) the AR clerk gave the name of the business "surgical center" and my account blaance $350 to My GF. I called this clerk back PISSED AS HELL, told her the 'wife' she talked to was my employee (technically, she's my business partner is a 1/2 time business doing programming projects). I told this clerk I was talking to my atty and I expect a written 'solution' to this issue before Monday when I meet wiht my atty, on a different business issue however. Any ideas. I'm thinking I won't sue, I just want to scare the panties off of this rude (rude to GF, VERY nice to me) clerk. I told my atty about it and he asked me what he wanted me to do, I said I'm thinking about a 'we'll sue you' letter. I'm not sure, we definatly aren't going to sue. She gave medical info, i.e. my surgery (the fact that it took place), and she gave account balance info. She threatened to send to a CA if I didn't pay by the end of hte month. Until now, I've neve missed a payment and always pay more than supposed to. ANy one have experiences like this, or any suggestions?
OC's are not regulated by the FDCPA, so you can't nail them with that. Perhaps there is some medical and financial privacy laws you can use?
