Breeze, OC ... no FDCPA help there.

Unfortunately they are correct if you approach it from a "validation" standpoint. However, OC's ARE required to proove a debt is reported correctly and accurately (if they are reporting it). See this section of the FAQ

(*&%$*! Well i'll have to send a letter making them verify the accuracy. They are a moms and pops type of finance Co.. had them back in 1997.. Had been off the report, eq reinserted(unfortunately correcty)... I don't know if they would be up on the laws, but need to send them something. I guess the letter with more FCRA jargon..

In you next letter sent to them, just state that you are in full dispute over the information they are reporting to the CRA's about this account. Tell them the information as I know it to be is not being reported correctly and you want an investiagtion.

Say nothing more!! Do not cite FCRA laws or anything else for that matter.

    Send it certified and registered!

When they receive it, immediately dispute it with the CRAs.

When the CRA reports back to you that it is verified, look to see on your credit report if it is notated as "Consumer Disputes account"

If it is not, file your small claims court immediately for their violations of the FCRA and possibly your state's laws.

I bet their next call or correspondence to you might include something more then a few letters!!

Make sure you give them the correct spelling of your name so they don't make a mistake when printing your settlement check out.

I've done this same thing about 10 times with 100% success!!

    Good Luck!
