I'm sure this has come up several times before, sorry, I'm at work and my search function always times out. OC (Heilig Meyers) sent debt of $271 to CA (Asta Funding) for collection. In the meantime OC went bankrupt. CA still reporting. Tried to verify OC and CA through CRA. OC was deleted, because of BK I'm assuming. Their notification address is now a parking lot. CA came back verified through CRA yesterday (end of 30 days) Also recieve a letter yesterday from Palasides Collection stating they have been assigned the debt and to direct all correspondence through them. On the back of the letter is a notice: NOTICE: In accordance to the FCRA, if you dispute the accuracy or completeness of any information involving you or your account with the SELLER, you may notify the Seller of the dispute by writing to: Asta Funding. I'm assuming they (Asta) have sold the account. Palasides would now own the debt if I'm reading right. Nowhere on the letter they sent tells me I have 30 days to dispute. So, basically I got each CA directing me to the other. Should I just send a validation letter to each CA? If Palisides has bought the debt, should there be a mini miranda on the letter they sent me since it is their original communication. There is partial mini on the bottom, but not the full mini. Any help is appreciated

That's exactly what I would do but I would recommend a time delay for the 1st one. I'd go for Palisades first and wait 30 days at least to send one to Asta. Maybe a week or so more. Yes. Absolutely. That is definitely not good enough. The fact that Palisades may be a subsidiary of Asta has no bearing on the matter.

Bill, If I can ask a question so I can better understand, Now even if Asta owns Palisides, and Palasides sends me a collection notice, it is also required to have the full mini-miranda noted on the collection form instead of just the "This is an attempt to collect a debt, any information obtained will be used fro such" ? Could you point me in the right direction where I can read about the laws required to state the mini-miranda rights? How can not having the full mini miranda on the collection letter be of benefit? I'm going to take your advice and fire off a validation letter to Palasides and see what they come up with. How could Asta sell a debt to a subsidiary that they own? I'm sure Asta has notified me in the past when this debt went default but I'll deal with them later. Hell I may never have gotten it since I have moved 8 times in the past 5 years.
