OC update, response to my letter

    Some may remember that I wrote to the original creditor of a supposed debt. The CA had put the same entry on my husband's report three times with same account numbers, different figures by 2.00 In addition, they never validated or responded to letters. They broke COL law by not putting the "30-day" blurb on the generic notice I got (and responded with dispute) or the COL board information. By writing to the OC, I made sure they knew I was making them aware of the violations and they would now be liable if they did not correct the situation immediately. I included a copy of the article by David Medine and John LeFevre of the Federal Trade Commission outlining their liability in this situation since they are now aware of the violations.

    I got a response today that says that they contacted the CA and they say they provided proof and they say that it was only reported once. (I now have in writing it should, at worse, be only once on my report and that the identical issues are violations, violations, violations!.....documentation for the judge!) They don't address the required information that is missing or the fact that it was never shown in dispute, blah, blah. The say the debt is valid but don't provide any documentation of it.

    So, I'm happy! I write a letter back and tell them the CA is clearly lying to them and provide proof of the tripled identical entries on my credit report (with all other vital info blacked out) and tell them that now have concrete evidence of the violations and the fact that the CA is untruthful with them and their liability is increasing!

    I fax it and am going to send it CC/RR tomorrow! All in all, a good bit of documentation to receive!

    That letter from the OC saying the CA told them it's only being reported once and that they've already validated the account to you, is gold. Talk about ammo for a lawsuit. I'd like to see them call this a "clerical error".

    Yes, I'm quite excited for the written statements it provides. I wish I could be a fly on the wall when they see the CR with the 3 identical entries. LOL

    Whould this be the Wakefield account? Who was the OC? On my account, the have Carepoint PC listed as OC. I can not find contact info for Carepoint PC and I don't think Wakefield will supply it.

    Have you had any luck with the collection agency board? I am still waiting for their response.

    Yes, that's it and it is Carepoint, P.C. (???). They wrote me on a Beacon letterhead, however. Haven't heard anything from AG but it has taken 45 days in the past. I have old letters for other CA's from them and I know what violations they write admonitions for and I outlined them for them...even using their terminology. I believe I can hear something any day now! :) :) :)

    I have a fax for Carepoint and an address...we would only have strength in numbers if you wrote to them, as well, and made them aware. I have a name, as well..do you want it?
