I had a Chase CC that weny to collections, I paid in a setttlement (long before I found this site) to the CA Coldata. I want to have these removed from my CR. TU's tradeline shows Chase with Coldata noted on the account. EQ just shows Chase no note of Coldata. EXP has Allied Interstate who is part of Coldata but no mention of Chase. Do I validate this with Chase or Coldata? If I validate with Chase (the OC) do they have to validate? I know the rules are different with the OC. Does it seem wrong that I paid Coldata but Chase appears on 2 of 3 CR's? I have disputed with the CRA's but they come back validated. Thanks nhokt
You can validate with Coldata. However, there is nothing in the FDCPA that requires an OC to comply with "validation", unless they have used their own internal collection department and acted as a third party debt collector. There are items in the FCRA and the FCBA compelling an OC to comply with validation and verification of reporting and billing matters. There is a section in the FAQ that helps you with an OC, and I will be expanding that section this weekend, so check it early next week for some more information. -Peace, Dave
