OC vs CA

    Ok, I have a very specific problem and would like some quick resolution. Can anyone site specific rules, law etc for me on the following situation. I had an account last year that I was late on 2 payments. It was turned to a collection agency. I finally managed to get enough money together and sent the Original Creditor the full sum over 2 months. I have copies of cancelled check even that they accepted the payment. I have the collection agency still trying to collect late fees from me for an account that I paid personally. The late fee was not billed by the original creditor but by the collection agency. Can a collection agency asses a fee when the orginal creditor accepted payment directly from me and the collection agency nevery had any part in the payment of the dept?

    Is this a cc debt? Medical?

    Was there a contract or terms of agreement regarding charges or deliquent payments?

    The CA cannot legally charge any fee not allowed for in the original contract, or not allowed under state law.

    The debt was a 5 payment plan with Domestication over 5 months. It's not a medical bill. They were charging the monthly payment to my debit card. I ended up running into some trouble the last 2 payments. I built a house and it took an extra 6 months to finish the house. I was paying 2 house payments and only living in one of the houses. It took me months to catch up. I choose to send the payment directly to Domestications and both times they accepted payment. I never dealt with the collection agency and they are still calling after I sent them copies of the canceled checks. They still claim I owe them $40 in late fees.

    Who or what is "Domestication"? Can you get a statement from the OC, which would show whether they consider your balance $0, or whether the OC added any fees?
