I have an old paid trade line on all three CRA's dated 7/99 as the opened date?( I don't think is correct) I think this is the day it was charged off it was settled for less than full balance. I paid the account off in 2002 the problem is the inaccuracies being reported from all three CRAâ??s and every time I dispute they come back verified. EX- showing paid closed. EQ- credit unknown charged off $0 balance before EQ was listing this account as paid as agreed (when I disputed this account again 12/06 EQ reinserted the first statement no notice was given). TU is showing charge off paid less than full balance but still showing full amount before payoff. I have disputed this account several times...I called the OC spoke with Phil, when I ask for the original documents to verify the dates and charges, he tells me in no uncertain terms I must first fill out a fraud packet before I can receive any statements regarding this account and because it is so old they may no longer have my information. He then calls my home and leaves a message on my phone stating he may be able to help me get the information I am requesting he states to send a validation letter asking that this debt be validated. My concern is what are my chances in his help being sincere. Can someone please advise me on the best solution to take at this point? I don't want to mess up my chances in having this removed.. If it is someone at the OC, it might actually be possible, but he sounds as confused as many CSRs claiming that a "fraud packet" is appropriate on an account that is actually yours but where they are misreported. You could, in fact, demand copies of their records under FACTA based on a police fraud report, but that doesn't appear to match the circumstances. It sounds like he was awake thru some, but perhaps not all, of his training course, and got back to you, perhaps after checking with a supervisor. Getting a call back is generally a good sign. If the account is reported by the OC, then they are the Data Furnisher, and therefore under FACTA, they are responsible for reporting accurately. As you have seen, disputes thru the CRAs often get only cursory review, if even the CRAs passed on enough of your dispute for the DF to make sense of, and in theory you could now sue under FCRA for their verified erroneous reporting, if it was worth it. It may be more direct to work thru the OC to get this fixed. The FACTA amendments to FCRA allow for disputing erroneous reporting directly with any DF. That is probably what he is referring to in suggesting you send a validation letter. Follow thru, send such a dispute and validation letter, under FACTA, include redacted copies of your erroneous credit reports to show what they are reporting, indicate that this was settled, and ask that the reporting be corrected. Send it CRRR, so you can prove they got it.

Will a simple "I disute please send me original doc' letter suffice? should I include FACTA and FCRA laws? also The CRA's have updated this TL I have truecredit monitoring svc and it is not listing in dispute, I have received a letter as well as the voicemail message from the OC, so they are aware I am disputing the TL. I appreciate the help..This is the only the problem I'm having on my credit report. I'm trying to refi and the updating and reaging of this account is killing my score!
NO. They are incorrectly reporting and you are trying to get it corrected. You want to do it in writing, as there is at least some legal basis for your request and their obligation to respond, under FACTA, and they seem to be aware of that. Your different reports also show a mix of correct and incorrect information, and you want it clear what it should be so you don't just go around and around adding new errors as fast as you fix others. You also want a reply from them confirming what the correct information is, in case they still have problems getting this fixed on your reports, and in case you have to use this to do rescoring to get approved.
