I defend the asbestos cases; thus, I couldn't agree with you more. I actually defend corporations on a premises liability theory. The plaintiffs claim that we had it on our property and they came on the property; therefore, they should be compensated for that exposure.
We had to put up a fence around our pool...they said to keep people out...IF THEY GOT HURT OR DIED IN OUR POOL (WHILE TRESPASSING~~~WE COULD BE LIABLE)??? There with-out our permission...AND WE ARE LIABLE???
I have been trolling here for the past three years...I thought it would be interesting to see what the internet had to offered those who needed help with credit problems in order to help me with the position I held back then and stumbled across this board. I have cheered each of you on(silently) and have witness how anything could be achieved with a little bit of determination. I am sure that there is a department at my company that scans boards for customer input, but its not mine. I work on process improvement and quality assurance. I can't give the name of the company. I have been lurking around for about three years. It started as a personal interest in what the internet offered in terms of information for consumers with credit problems. I kept up with the board because it was interesting. I read it almost everyday and when my company is mentioned, I am sometimes elated and at other times horrified as to what is being said, but overall, everyone here is fair. I know that there are times that I could answer a question that would clear up an issue immediately, but I know I can't. Just keep your determination and all of you will succeed.

Yes, you would be held liable as the pool is an "attractive nuisance" and you can't expect kids to understand the dangers. Therefore, they hold the adult owner responsible. (sorry, that's just the facts as they are - not how I may personally feel). However, the fence will help cut down on your percentage of liability - depending on the type of fence and gate you buy. Must be self-closing/locking!!!! Sorry, you may be able to guess what field I'm in and it's not law!
Hey Dpray...I used to do title searches in a courthouse that *still* has exposed pipes wrapped in asbestos. I almost got fired over my reaction to the fact that no one was going to do anything about it. Apparently the county can't afford it, and so like any small town in eastern Kentucky...the problem simply doesn't exist. :::sigh::: L
George, To the insurance industry a pool is classified as an "attractive nuisance" thus, yes, if someone jumps your fence, dodges your guard dog, ignores your posted safety signs and gets hurt, odds are good that you'll be found liable. Stupid rules... Dancer
