Offically in the 600 Club!

    I'm finally fully in the 600 Club!

    Did have one interval where I had a foot (and one extra) in the 500, 600 AND 700 club all at the same time.... Much as I'd like that 700 score back - at least TU is finally out of the 500's!!!

    Now... 700 Club here I come!

    BTW, I was reading your additional documents posted today on creditcourt.com on your student loan suit. The Motion to dismiss based on jurisdiction from the dumb attorney in Phoenix, that says that he is entering as a special appearance on the issue of jurisdiction only, yes? That's how I read it.

    I'm thinking if you win the jurisdiction issue or have it bumped to another court, they're likely not going to be willing to pay for additional attorney services.

    Well, it would make sense to me that they wouldn't for a paid account with a bogus history that could easily be deleted. Sense though doesn't always seem to factor in.

    I was curious if that was correct on the special appearance, if that is the ONLY thing he will be arguing for, as I read it, and if so, is there a hearing on the jurisdiction alone?

    What I'm thinking is, if it's all scheduled to proceed in one day, jurisdiction first, then your claim, the dummies will have an attorney there that can only argue the jurisdiction by his own motion -- what would the rest be, a default judgment or he would just lose for knowing nothing beyond the details applicable to jurisdiction?

    Yes, the attorney did put in a Special Appearance JUST for challenging jurisdiction. I think they assume they will win that issue. (I have other ideas!)

    What will happen is there is a "hearing" set up where the Judge will rule on their Motion, my answering Motion, and then go from there. Neither party is expected to go to that hearing and are not allowed to give any evidence. (i.e. it's just a "hearing" for the judge to rule).

    I am finishing up my Motion to Deny -and probably will post it on CreditCourt. I think I have a good chance of winning the jurisdiction issue AND having the Motion for Sanctions denied.

    What they (the student loan people) do after that is anyone's guess. If I win - then they DO have to come to court. Since I've got some pretty strong issues (six years too long on my credit report) I'm not giving up!

    Thanks for all you help again Sassy - much of my Motion to Deny's oomph comes from the things you found for me!

    it such a great feeling breaking into the 600 zone. When it finally happened to me with eq and ex I was speechless.. LOL


    Strangly enough my TU took a huge nose dive to 500 even... BLAH!!!
