I am preparing to file against Bloomingdales on and am wondering about the success rate of such suits in Ohio. I have them on several FCRA violations including not marking the item in dispute and verifying inaccurate info to all three CRA's. I have prepared an ITS and am looking for any suggestions from my fellow CNET'rs.
I'm just curious, because GMAC is driving me crazy--but if you are interpreting this part under 623 of the FCRA, I'm reading where it isn't actionable by the consumer. Maybe I'm missing something?
I may be interpreting wrong that's why I posted before I filed. This is what I am basing my violation on, if it is an incorrect assumption, let me know. Duty to provide notice of dispute: If the completeness or accuracy of any information furnished by any person to any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer
Well, that part is under (a): (d) Limitation on enforcement. Subsection (a) shall be enforced exclusively under section 621 [§ 1681s] by the Federal agencies and officials and the State officials identified in that section. But I know there is a way to sue OC's. Hope someone will enlighten us! And I could also be flat out wrong about (a)!

Ohioan here Have you tried filing a complaint with the Ohio Attorney General? You can do it online. Also there is great info there that you may not be aware of such as the CSPA Consumer Sales Protection Act. Creditors and debt collectors fall under CSPA and you may be able to find something in there that could be helpful to you and give you a sense of direction.
