I have a negative that will be off in may as it has reached the 7 year limit. But they have haNDED IT OVER TO A COLLECTION AGENCY WITHIN THE PAST 6 MONTHS WHERE THERE HAS BEEN ZERO COLLECTION ATTEMPTS. mY QUESTION IS HOW DO i GET THIS COLLECTION OFF MY REPORT FOR THIS CREDITOR OR DOES IT REMAIN ON MY REPORT FOR AN ADDITIONAL 7 YEARS UNDER A DIFFERENT NAME ?? i FIND IT UNLIKELY THAT THIS WOULD BE THE CASE BUT WHAT DO I TELL THE CREDIT BUREAUS IN GETTING THIS OFF. tHANKS FOR INPUT AND HELP IN ADVANCE
What Date of Last Activity is showing for the new CA? In a perfect world, it would still come off in May, however, it is conceivable it has been reaged (illegal) to current.
If the CA's TL is on your report after the original 7 years from the OC's reporting, I would interpret that as prima facie re-aging and I would immediately 9after May) sue the CA for the FCRA violation.
Not to mention the fact that the debt is past SOL in all states. When the CA contacts you, send letter stating "past SOL" and "cease and desist".
