there is a account from verizon wireless , says charge off $76.00 I paid them before they sent me to collections the full amount I owed which was the $76.00 I beleive. what do I do I just orderd the one report with eq and can dispute online.this would not be a chargeoff would it ?? thank you
One path...Send Validation letters CRRR to the CA. When you get the green cards back, send disputes to the CRA(s) which show the item. Sample letters are in the Sample Forum. When the disputes come back they will either be successful or not...if successful you are done...if not, the validation letters will either get the item deleted or not...if not, send Estoppel and hope they correct the reports then or you can threaten/take them to court for violations of the FCRA and FDCPA at $1000 per and they will remove them then or pay you. An alternate path (can and should be done at the same time) is to contact Verizon and find a supervisor who you can fax the proof of your check to and claim there is NO reason you should have this account in collection and they should contact the CA to remove the item immediately. Start nice and if they do not comply with your wishes tell them you will simply file a suit against Verizon for defamation of your credit file in violation of the FCRA. As Kiyi said if you have the cancelled check you are in posession of proof you paid the OC prior to collection...so you will have no backlashes from this path...it may NOT be so easy...but you will prevail. Dave, I have a couple of 'newbie" questions. Tell me if I am correct about this scenario as I undersrtand it. A "chargeoff" is a debt on an account that the creditor originally tried to collect, probably wrote off in their accounting system and flagged it as "chargedoff" on the CR report. It could stay that way till SOL or they could have sold the debt to a CA. If so the CA begins to come after you, possibly for that amount or maybe more. If a long time passes and they have not been successful, it could have been bounced to other CA's and maybe depending on the amount, they might ask for less, just to get something rather than nothing at all - hoping you settle to resolve the issue. This thread is talking about a debt that was paid, but the creditor (Verizon) probably received the money at the same time as they were sending it in for collections and the wires got crossed - "no pun intended!" But, am I correct about the "chargeoff" concept? I guess any debt that the OC no longer is pursuing after a very long time internally, probably has been writen off their books. Is the above concept applicable to any chargeoff item, whether previously paid or not? In other words you are saying to send validation letter to CA, ensure it has been received via CRRR and then ask the CRA to dispute or verify the item. If not successful you mentioned that the validation letter hopefully will get the item deleted, if not then send Estoppel, court, etc. So what you are saying is to attack both the CA and the CRB at the same time?
Essentially that is correct...here is a good explanation of Charge Offs. Yes that can be applicable to any item on your report. You would not always use that method...but in this case the information is WRONG, she already paid the OC so the CA is in error. You are entitled to proof that the information on your report is complete and accurate. They must comply. Yes I would recommend during validation you "attack" both the CA and the CRA at same time...get them to trip up. The CA must mark the account as "in dispute" so stagger the dispute slightly after the validation. -Peace, Dave
