I disputed some items a while ago and on Sunday night/Monday moring I got my email notification that three of the items had been deleted. Today I check and there back on there this morning two days later? What can I do?? I'm very upset at them for getting my hopes up.
They are supposed to notify you within 5 days of an item being reinserted. If they don't it is a violation of the FCRA. The item reinserted also is to be "certified" as correct by the reporter of the info. Why not give the cra a call and ask them why if it was deleted, is it showing?
LKH, Is there a difference between certifed and verified?? They really have to notify you within 5 days? They did this to me with a 30 dollar CA that I disputed in May and it came off and as of Dec 24th it was back on for some reason. Should I wait until the 6th day to call or should I wait a week or two to allow for mailing time???
That is the word the FCRA uses. Is there a difference? I doubt it. The cra calls the ca and says does LKH have an acct with you? They say yes. That's it = verified, certified whatever. I would wait til the 6th day. That way, if they haven't mailed out an update yet, they have violated the FCRA and you may be able to use that to get it permanently deleted.
LKH - do u think there's any way to actually get compensated for $1k for the CRA's violation? TU reinserted an entry into mine and I want to COLLECT $1k as well as get it permanently deleted. Where does the burden of proof fall? Do they need to PROVE they sent out a letter to me informing me of reinsertion or can they just state they did? Because I KNOW they never send things out certified..
