in April we filed several years worth of back taxes part of which satisfied and released our tax lien that was being reported as we owed $1413. After we filed taxes we actually only owed $400.00 but with the refund we should have recieved if we had filed on time, we only had to pay $45.00. Immediately I verfified with the CRA in May . It came back verifed but now it shows relased which is good . But my question is since I actually only owed 400.00 not $1413.00 isn't the public record technically wrong ? Can I get it deleated because the amount is incorrect ?...Is it too soon to have them re-investigate it ? Should I send them copies of tax form (doesn't sound smart thing to do) to show the amount is wrong ? Thanks for any help... Jamie
Definitely don't send the CRA any documents about the lien. You have a perfectly legitimate dispute since the amount is incorrect. Dispute the amount. Don't say what the amount should be, just dispute as "incorrect amount." Since the lien is now released, the court records dept. MAY not bother to respond to update the record, in which case the entire entry will be deleted. Now, there is one other thing to consider and I'm just throwing this one out there because I'm a huge believer in having the next step planned. I have 2 liens reporting on 2 CRAs which have both come back verified. I have decided to wait until the end of the year to dispute them again on the basis of incorrect information as part of CHOD. I believe that is when I have the greatest chance of them "slipping through the cracks" and I don't want to risk the chance of having the CRAs reject my CHOD disputes as being frivolous because I've tried too many disputes already. I'm not recommending whether disputing now or later is better for you. I just wanted to pass along a couple of options for you. Since liens are court docments, they tend to be the stickiest of all to dispute off of your reports and even with all of your best efforts, you may be stuck with them (although the info reported DOES have to be correct) for the 7 years after they're paid. Another piece of my personal experience, EQ was the easiest of the CRAs to deal with. They have now deleted all three. TU and EX are both still reporting two and they have both noted on the entries that they were verified. I haven't heard about the dates for this year. I didn't discover creditnet until last year's CHOD was almost over, so I'm not sure of the exact dates. But no doubt, there will be ample notice.
