Well, I've sent out the validation letters, the follow-up 15-day letters and the 48 hour letters and I have not heard from the CAs or the OCs. I was straightforward but not overly rude in the letters. Just to the point. I just pulled my report and they have not even listed them as disputed. These are old CC accounts (1996) and are charge-offs. One has been sold, two have not. They are past the SOL for my state/contract state, if they are determined to be revolving. Each one has several errors on the reports: amount due, re-aging, a different age/amount for each CRA, never listed as disputed (have been disputed in the past), etc...I have never denied that I owe a portion and have even offered to pay what I thought I owed several years ago - they refused. How should I word this letter? Should I just go for the "I will sue in small claims court?" or " I will send complaints, Attorney General, etc", or what????? I don't think they fear complaints that much, but I could be wrong. Some guidance needed here. Also, most of them have pulled hard inquiries after receiving the validation letters. Disgusting. This is why I have some disdain for this board. Everybody says "Sue!", "File in court for violations against the FCRA or the FDCPA", but nobody offers step by step how tos, which is what I personally thought a board like this would be like. You might try a site like http://www.id.uscourts.gov/pro-se.htm This is in Idaho, and I am not sure what state you are trying to litigate in. I am almost to the point where you are, and so could also use some handholding about then... I will be filing in about 30 days. I have not clue one as to how to go about it, but I know that they are incorrectly reporting a paid debt on my credit report, and there has to be some way I can make it stop. I would go to www.google.com and type in pro se and your state. I am sure that there are some sites that can help. Make sure you have as much paperwork as you need. Do you have a papertrail of certified letters and copies of your credit reports showing proof of violations? Do you know what you are filing on and where? Sit down and write down everything you want to accomplish. That's what I am doing. C'mon people, all of you that have filed and argued successfully in court pro se, give some input to this woman!
Thanks Kirby, glad to know it's not only me! Hope someone will answer our questions as I've seen some great info on this site and I really do not want to go to court! I just want them to do what is right! Help - anybody???
