Old credit reports as proof?

    Will old credit reports showing earlier chargeoff dates than current ones hold up as proof for a dispute with CRAs?

    Yes. If the original charge-off date has been changed, it's called re-aging, and it's illegal.

    Thanks very much for the reply mindcrime. Would this apply for example if I had a TU report which shows a substantially earlier chargeoff date than Experian or would they only respect their own reports?

    There has been some talk about this question, using a different report to dispute. I am not sure if anyone has tried it, but I do not believe it would be very effective.

    1) they could still claim theirs is right and the other CRA is wrong.

    2) they could just deny the other CRAs report altogether, it would be easy for someone to alter the report and send them a copy of the fake report.

    What other ways have you tried to dispute it? If everything else has failed, give it a shot.

    I really wish we could get the 3 CRAs together, show them that virtually none of the info is identical on the reports, so it must all come off!!! :)

    Thanks for your reply radiohead. I think your idea sounds like a great one!!!. Get all 3 in a room and prove that most if not all that they are reporting is inaccurate at best.

    With regard to your question I have not tried disputing the item yet. Here is the situation , these are original creditors who charged off in late 1995 early 96 depending on which report you look at it. I am not sure how to go about disputing these items, tey are indeed mine from my younger and stupider years. I am also fearful of restarting collection activity as the SOL nears. The chargeoff dates are not horribly wrong(approx 6 months) and I don't have any proof(besides other CRA's reports) as to exactly when they were charged off. Do you have any suggesstions?

    How much is the charge off for? What is your SOL? seems like it would be past by now.

    If the chargeoff is low, I doubt that they would sue, especially after all this time.

    2 different accts for approx. 2K each. The SOL in my state is 6 years so it is either up or very close to being up. Should I wait until it is the SOL has passed (based on the latest chargeoff date to be safe) and then dispute with the CRAs?

    Since you are so close, I guess you can wait. Right after the date passes, I would tell the CRAs 'not mine'. With that much age on it you should have a good chance.

    Hey das,

    You might already know this - I think for those chargeoffs that happened before 1997 - the reporting rule is 7 years after the chargeoff. It was the 1997 change that made the date 7 years after the date of the first delinquency that led to the chargeoff.

    So the date of the chargeoff is important for those old guys. I don't know if that helps you figure out what to do.

    For those accounts that charged off in late 95, they will becoming off your reports late this year. I would dispute them now, as it is so close to the purge date, that they may just delete them now.
