i agree with dixie... send them the validation letter, and follow up strategies Dispute with CRA's etc. in other words follow the tried and true method that others before you have used I would not tip them off that I was aware of the SOL being up I would let them rack up violations and then keep the SOL for the "knockout"
This charge off has been dropped by all CRAs. There is nothing to dispute with them about this matter. I wont mention any SOL, but I feel that since the SOL has expired that maybe I just need to do cease and desist. Let me know.
Re: Re: Old unpaid charge off usually it is the state the consumer lived in when the contract was signed, but if they have found the consumer in another state they might choose to sue there if the SOL is longer in that state, and it was allowable. They may be prohibited to do that by statute. Also sometimes the contract will specifiy which state law is applicable in these cases
