one last (i hope) lawsuit ???

    I am filing on EQ Monday. Should I or should I not send a settlement letter? My court won't allow it to go with the actual lawsuit, but I could fax or send CRRR to the registered agent the lawsuit goes to.
    Opinions??

    How about hiring your own process server to serve it and then you can attach the settlement offer to the summons when it's served. If not, then I would fax it but make sure it goes to the person that is getting server. Otherwise, the person that gets served may never see the offer.

    I will ask if we have that option. The way our county small claims works is this: If it is a corporation being sued it only costs $20 to file and they send a CRR to the registered agent. I was just going to wait about 4- 5 days and send a settlement offer, along with a copy of the small claims suit CRR to the same registered agent. Does this sound right?

    I wouldn't offer a settlement letter. I'd wait til they contact you. Otherwise, they'll know you want to settle off the bat and you'll lose a bit of position...

    But I know your case is strong and you can get some money and deletions.
