one last try with don richman

    I made my last try to avoid a lawsuit against transunion. Sent out my email to don richman and I hope he responds. Basically I put an online dispute on july 20 for an incorrect cc. They never put it in dispute until august 9th. They told me I canceled it, then I never put it in dispute, then I already disputed in june and the computer would not let me dispute, and finally I put it in dispute last year and the computer never put it in dispute. 4 excuses why they cannot follow the letter of the law. I am gonna be pissed if they make me go to court but I guarentee I will not let it go to federal court- it will remain in small claims where they cannot out lawyer me. Once again a CRA risks a lengthy and costly lawsuit over the trivial. They will never learn.

    I am still amazed that you got out of the priority department! I wish I could pull that off (without a lawsuit I mean!)

    How can you guarantee if you file suit, that they won't get it transferred to federal court. I hate to tell you, but for the most part, all it takes is a motion to transfer. This happened to me with experian. I filed a motion against transferring and was overruled. It's not easy to stop it if they request it.

    As far as the "priority dep't" I also got out of it. I was in it because the company I work for has the word attorney in it. I asked what valid reason that is to not be able to speak with cust service when I need to. I finally got a priority dep't rep that agreed with me and got me out.

    I cannot guarentee anything. I will just do my best to stop it. If they want federal court that is fine becaues I already have a lawyer I work with. It will just cost them even more money in the end.

    How does anyone else get out of the priority dept? I did threaten to sue them! I think they are atrocious to work with. I still don't see how they have the legal right to segregate my file and make it harder to access a rep. I hate this "we'll take your number and get back with you." It is such a hassle--they return the call, get voice mail, I call them back, leave a message, etc.

    Been in the priority dept. for the last couple of months. Results:

    - 2 Deletions of accounts I've been disputing since March 2002
    - 1 Judgement deletion
    - 1 tax Lien Deleted, but then reinserted

    Not sure priority dept. is a bad thing?! I think they actually INVESTIGATE ALL DISPUTES! Don't know if normal CR does everytime.

    Also, I dealt with Don once, he was helpful - deleted 4 accounts for me. But then I got a little *pissy* with him, challenging him on TU's procedure issues. Then he stopped being so helpful!

    Maybe you are right, Javan. I certainly hope so anyway. My first dispute with TU will be over on Fri I think. I don't know because no one will call me back from the priority dept. I can pull my report online all day long, but it doesn't mark the items as in dispute, so I don't even know if they started it or not. I think it is frustrating not knowing exactly what is going on. I guess that is the downside to being a micro manager/analyzer of this stuff!

    Good for you, Javan. Congratulations! Sounds like you are making some great headway with this.

    Thanks! I just faxed a *re-insertion* letter yesterday. I'll let you know how/when they respond.
